1. About XI Ai

XI Ai (accessible at www.xiaisoftware.com) is a football analytics platform that monitors odds movements across 25+ leagues and multiple bookmakers, runs statistical and machine learning analysis, and generates selective data-driven match alerts. XI Ai is operated by Ernyei Ervin-Vasile, Vienna, Austria.

2. Acceptance of Terms

By accessing or using XI Ai, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, please do not use the service.

You must be at least 18 years of age (or the legal gambling age in your jurisdiction, whichever is higher) to use this platform.

3. Nature of the Service — No Gambling Advice

• Our alerts are statistical outputs based on historical data and machine learning models.
• Past performance does not guarantee future results.
• All betting and wagering decisions are made solely by the user at their own risk.
• XI Ai accepts no liability for any financial losses arising from use of our alerts or the Strategy Lab.

Users are solely responsible for ensuring that sports betting is legal in their jurisdiction and for complying with all applicable local laws.

4. User Accounts

• You must provide a valid email address to register.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorised use of your account.
• One account per person. Creating multiple accounts to circumvent plan limits is prohibited.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription Plans & Pricing

XI Ai offers the following plans:

• Free Plan: Access to limited features including the Near Trigger watchlist.
• Pro Plan (Monthly): €29.90 per month, billed monthly.
• Pro Plan (Annual): €299.00 per year, billed annually (equivalent to ~€24.92/month).

Prices are inclusive of applicable Austrian VAT where required. All payments are processed securely by Stripe.

6. Cancellation & Refund Policy

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain Pro access until that date.

EU Consumer Right (14-Day Cooling-Off): In accordance with EU Directive 2011/83/EU and the Austrian Konsumentenschutzgesetz (KSchG), you have the right to withdraw from a subscription contract within 14 days of purchase without giving any reason, provided you have not actively used the Pro features during that period.

To exercise your right of withdrawal, contact us at support@xiaisoftware.com with the subject line "Refund Request" within 14 days of your purchase date. Refunds will be processed to your original payment method within 14 business days.

Annual plan refunds after the 14-day cooling-off period are not provided unless required by applicable law.

7. Acceptable Use

You agree not to:

• Scrape, copy, redistribute, or resell XI Ai alerts or data without written permission.
• Attempt to reverse-engineer, decompile, or extract our ML models or algorithms.
• Use the platform to facilitate illegal betting activities.
• Share your account credentials with others.
• Use automated tools or bots to access the platform.
• Upload or transmit malicious code or interfere with platform security.

8. Intellectual Property

All content on www.xiaisoftware.com, including but not limited to the XI Ai brand, alert algorithms, ML models, Strategy Lab, design, and text, is the intellectual property of Ernyei Ervin-Vasile and is protected under Austrian and EU intellectual property law. Unauthorised use is strictly prohibited.

9. Disclaimer of Warranties

XI Ai is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The service will be uninterrupted, error-free, or available at all times.
• Alerts will be accurate, complete, or profitable.
• The platform will be free from viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by Austrian law, XI Ai and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits or betting losses, arising from your use of or reliance on the platform.

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount paid by you to XI Ai in the 3 months preceding the claim.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Austria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Vienna, Austria, without prejudice to your rights as an EU consumer under applicable consumer protection law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or platform notification. Continued use of the service after the effective date of changes constitutes acceptance.
